PhotoPICO Movie Voucher redemption Promotion

TERMS AND CONDITIONS

  1. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Information on how to participate and the offer are part of these Terms and Conditions.

Participation

  1. The promotion is open to individual Australian residents “Participants” who are not employees of the Promoter, companies which are related to the Promoter, or agencies associated with this Promotion.

Purchase Period

  1. The purchase period commences at 9:00am (AEDT) 23rd March 2016 and closes at 11:59pm (AEST) 30th April 2015 (“Purchase Period”).

Eligible Purchases and Gift

  1. Where a Participant makes an “Eligible Purchase” they can submit a claim for a Gift (see clause 7).
  2. An “Eligible Purchase” is a Participant’s purchase during the Purchase Period of any new PhotoPICO product/s from

    . Participants must retain their receipt as proof of purchase.
  3. “The Gift” is between 1-5 adult movie ticket vouchers (allocated based on value spent in a single transaction as evidenced by a single receipt) redeemable at Village Cinemas, Greater Union, Birch Carroll & Coyle or Event Cinemas in Australia as follows:
    • Purchase receipt value of less than $50 is redeemable for 1 (one) x single movie ticket voucher;
    • Purchase receipt value of between $50-$200 is redeemable for 2 (two) x single movie ticket vouchers; and
    • Purchase receipt value over $200 is redeemable for 5 (five) single movie ticket vouchers.
  4. Vouchers expire 30th Nov 2016.
  1. Participants accept that use of the Gift is subject to any further terms and conditions imposed by the relevant cinemas. This Promotion is in no way sponsored, administered or endorsed by Village Cinemas, Greater Union, Birch Carroll & Coyle or Event Cinemas.

Multiple Eligible Purchases

  1. 9. The Participant can submit more than one claim during the Promotion Period provided each claim is made on the basis of a separate receipt and is otherwise made in accordance with these terms. Claims will be assessed on a per receipt basis. For example, if a Participant purchases two PICO Photobooks each valued at $105 in one transaction during the Purchase Period, they can submit a claim for 5 vouchers (being a spend of $210 in one transaction). If a Participant purchases a single PhotoPICO product for $105 during the Promotion period and then later purchases another PhotoPICO product for $105 during the Promotion Period, they can submit 2 separate claims each for 2 vouchers (being 2 separate spends of $105).

How to claim the Gift and deadline for claiming the Gift

  1. To make a claim, all Participants must email: photoPICO@canon.com.au with their full name, postal address and phone number and attach a copy of their receipt in order to be received by 11:59pm (AEDT) 30th May 2016.
  2. Failure to produce a qualifying receipt will result in the forfeiture of any right to the Gift.
  3. No responsibility will be accepted by the Promoter for late or misdirected claims.

Distribution of gifts

  1. The Gift will be posted to the Participant named on the claim submitted to the Promoter in accordance with these Terms and Conditions. Gifts will be posted via standard post within 10 days of the claim submission.
  2. It is the responsibility of the Participant to provide correct details. Delays and non-distribution of claims that arise as a result of supplying incorrect details are the responsibility of the Participant. Gifts are not transferable or assignable.
  3. Any costs associated with accessing the Canon PhotoPICO, scanning or copying receipts, or otherwise submitting a claim is the responsibility of the Participant.

Collection of personal information

  1. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including agents, contractors, service providers, suppliers and as required, to regulatory authorities. Participation is conditional on providing this information.
  2. Personal information collected by the Promoter in connection with this promotion will be managed in accordance with its Privacy Policy (available at www.canon.com.au/Privacy-Policy), which contains information about access, correction and complaint processes.

Other conditions that may invalidate a claim

  1. The Promoter reserves the right, at any time, to verify the eligibility of Participants and the validity of a claim, and to invalidate any claim that is not in accordance with these Terms and Conditions, or to disqualify any Participant who tampers with the claim process.
  2. Incomplete or illegible claims may be deemed invalid, although errors and omissions may be accepted at the Promoter's discretion.
  3. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

Liability

  1. Nothing in these Terms and Conditions limits, excludes, modifies or purports to limit, exclude or modify the statutory consumer guarantees under the Competition and Consumer Act, or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”).
  2. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any personal injury or any loss or damage (including loss of opportunity) - whether direct, indirect, special or consequential - arising in any way out of the promotion, including (without limitation): (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by an Eligible Claimant; or (e) use of the Gift.

General

  1. This promotion is governed by the laws of New South Wales. The Participant and Promoter submit to the nonexclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia and any courts that may hear appeals from those courts about any proceedings in connection with these terms and conditions.
